Toilet Ordour at Work

    We are working in a brand new building which is a PPP facility. We are now here just over one year so the snag list should be complated. However there is a major issue with the toliets in the staff facilities. ~~~There is what seems to be an open drain running through the loos which stinks from time to time. It is tat bad that it is impossible to use the toilets as the stentch is unbearable and fummy.

    What is the health and safelty laws arouns this? Where do I issue a complaint?

    Your employer, or if you are the employer, the Landlord. If you own the building you need to sort it out ASAP incase someone complains to the HSA :p

    I am working in the building as stated in the first post. I do not own the buildiing as it is a PPP (Public Private Partnership) as previously stated. Does anyone know what the legislation is regarding such as issue as Health and Safety regarding touilet facilities. I would like to gather some information before approaching my employer first.

    Sorry my flippant was not meant to obfuscate the fact that the relevant authority is the HSA. Their website www.HSA.ie will provide you with some useful links. The Statute book (google irishstatutebook) will provide you with the legislation but I wouldn't make that your first port of call.

    www.workplacerelations.ie may also be of some assistance.

    A word of caution - if the first report of an issue from an employee of mine was here is XYZ legislation and you are legally required to do ABC my response might not be as positive as someone who had tried to resolve the matter though other means. That said perhaps you've exhausted that avenue.

    appropriate action is to ask your employer to raise the issue with the landlord, they have a duty (both under the lease and by law) to provide accommodation which is up to standard. If the Toilet facilities are not working or unusable then the landlord must rectify the situation. Arguing health and safety is a matter for your employer.

    on a seperate note it is worth being aware of the fact that fumes from sewer pipes (methane) are highly dangerous and as a minimum would lead to headaches but can in fact kill.
