Credit Agencies and Defamation

    Say I have a service from company X and through X's cock up they get my bill wrong. I refuse make the overpayment and instead pay only what I should pay. X pass the debt on to debt collection agency Y. Has X defamed me?

    Let says Y fails to collect the debt and passes my information on to credit referencing agency Z. Has Y defamed me?

    Would it only be defamation if someone was to check my credit score in the future or is it defamation as soon as they contact the debt collection agency or credit reference agency? Qualified privilege springs to mind but I'm not good with Tort at the best of times.

    A quick google search throws up some US legislation do we have anything?

    Is the ICB the only agency here that deal with credit scores for individuals? Do they only deal with loans rather than things like mobile phone contracts, sky bills etc.

    Correct. The ICB only deal with banks and credit unions.

    Phone contracts and Sky etc do not come under their remit at all.
