Transfer ownership in order to get insured?

    Hi, hoping someone here can give me some advice on the below.

    My sister in law has a car sitting outside her house that's untaxed, uninsured and unused for the last 2 years.

    It recently passed the NCT, I'm going to get it taxed and I have an insurance quote. I'm just wondering. Will I also need to get the ownership of the car transferred to my name if I am going to be the only person insured on it? Whenever I do get around to getting my own car, possibly this year sometime, I will just be giving it back to her, I'm not buying the car off her.

    I'll need to get a statement from the guards stating it's been off the road before I get the tax won't I?

    Yes you will have to get the car transfered to your name, you need to have an insurable interest in the car, that's the term they use iirc.

    Regarding the tax, just fill in the transfer of ownership document and pay the motor tax from that date - hint - do the transfer on the 1st :)

    Most insurance companies will ask you if you are the registered owner of the car before quoting you on your own policy as the policy holder must have an insurable interest in the vehicle.

    The only way around it is to get your sister in law to insure it as her being the main policy holder and get you added as a named driver on her policy temporarily.

    Tax is only liable to the new registered owner from the begining of the month of when ownership transferred. If the car remains in your's sister in laws name then yes she will need to declare it off the road and get the Gardai to stamp it before taxing it again.

    Merely transferring it into your name with the intention of reversing that transfer at a later date without any value changing hands is unlikely to permt you to get valid insurance. You may not care but you would be better including some value - eg she sells it to you today but retains the opportunity to buy it back from you at a later date.

    Could get sister to write up a receipt saying car sold to x, payment received in full, no need to mention a price.

    Why so? Shannon dont care how much, if any, money changed hands; they just change the ownership details. Why would it matter if the car was handed over for free, or if the intention is to hand it back at some point down the line?

    1 Euro would be enough. Just some nominal amount. I honestly doubt any receipt would ever be needed. The completed VRC is evidence enough of transfer of ownership.

    I didn't suggest full value had to pass. It's easy to exchange an email or letter with a sibling to ensure that the "insured" has an insurance interest. It's easier than the 1% chance that it might be relevant.

    I can see what you mean Marcusm but how would they know if I've actually paid money or not?

    I'll get her to send away the transfer of ownership cert and take it from there.

    Your name on the VRC will be accepted as proof of ownership.

    No one will ever ask about how much you paid. If they ever did, say 1 euro.

    Just do the transfer. Insure it with your own policy and the transfer will also take care of any back tax issues so no messing with gardai getting form signed.

    Thanks for all the replies folks.

    So, I sent off the transfer of ownership form on Wednesday. Rang the motor tax office in Shannon today as I figured they would have only received the form today in the post. I rang at 3.55 this afternoon but they were already closed.

    So, I will be insured as of midnight tonight and I'm heading home tomorrow to pick up the car.

    My question really is will I have a few days grace to get it taxed if I was stopped by the guardai? Seeing as the ownership change form was sent a few days ago and I'm going to the motor tax office on Monday to pay the tax and it's going to be backdated until the start of the month anyway.

    Shouldn't be an issue. The chances of seeing a checkpoint are very low. The odds are in your favour.

    If stopped, you may be fined for not having a valid disk displayed, unlikely. They will ask for you to produce your tax and insurance in a garda station of your choice within 10 days. If you do that, normally all is finished with and happy motoring. If you don't, expect a summons in the future. So, If you believe you will have a valid disk within ten days, you should feel safe enough, with only a possibility of an on the spot fine.

    Although, maybe I'm just reading into your choice of words but why the doubt in "If this is true"? Why would I bother lying about such a thing?!:confused:

    I meant this is what you were told. Not that you would lie about it. :o
