P45 Copies from Last Employment...

    Hi all, I have a little query that I'm hoping someone could help me with...

    I'm owed emergency tax from 2010, which was my last job in Ireland.

    They gave me my P45 , which I subsequently lost,

    I am wondering do they keep all past employees P45's on file, and would they be able to print another copy for me?

    Possible, but no guarantee.

    Your employer should have made a P30 return to Revenue anyway, sot hey likely have that information and you just need to make an annual return.

    Go to www.revenue.ie and use the Contact Locator to get the number of your local tax office. Call them and say you think you overpaid tax in 2010 and ask them what you need to do to claim it back. As it's so long ago, you shouldn't need your P45.

    Thanks for the replies.

    I just called revenue there,
    and it seems things are more complicated than previously expected...

    They there is no details whatsoever for the year 2010 on my tax history, apart from the name of the company.

    I was paid minimum wage so I don't think I paid much tax...but I do remember some deductions appearing on my payslips. ( Aswell as the original emergency tax)

    I will go in to the office, and request a copy of my p45,

    But as nothing was filed with revenue, does that mean they took my emergency tax for themselves?
    Would I have any way of proving that?

    Revenue told me they are in the wrong for not updating my tax, and also that they have to keep a copy of my p45 for at least 6 years.
    ( If they didn't have it, she said I could not reclaim anything)


    Could they be in trouble with revenue if I report this?
    Should they have paid my emergency tax to revenue at the end of 2010?
    Should I be looking for my money back from them, and not revenue?


    Any advice very welcome please!

    Only in proportion to your liability - which you suspect is quite low. The employer would bear the vast bulk of hte responsibility.

    Payslips, I am not sure of... I hope I kept them and will have to search, as I moved house afterwards.
    There is a chance I may have none.

    This is my plan - to go into them, ask for my p45, ask that they declare my tax to revenue so I can get it back.

    Are they likely to refuse if they know they are in the wrong?

    If they did not give my emergency tax to revenue, is it possible that ( if I cannot locate payslips) no proof exists anywhere of my overpaid 'tax'?

    Do you know if the one euro levy goes through revenue, because that is one thing I definitely remember on my payslip!



    I am so angry right now! :mad:

    If I do not get it back, I will certainly report them, will there be consequences for them if i do this?

    What 'one euro levy'? That sounds like you were scammed.

    Whoops I meant the one per cent tax, sorry about that confusion!

    Still searching for payslips and proof, I will be going in to confront them during the week.

    My friend tells me I can call the Law Library for free advice, I never heard this before but I will give it a try.

    I will have to find out how to file an official complaint.
