Faulty P3x4 hand gun

    Hi Folks,
    the girlfriend bought me a P3x4 hand gun from Airsoft in Limerick as a christmas present. Its a lovely replica gun and feels just like a real gun.
    The problem with it is that when you pull the trigger, the hammer isnt moving, so it wont actually shoot. Its a gas powered gun.
    I brought it back to the store today to get it fixed or replaced (cant wait to use it). So the GF went in with it, comes out and said it will be next week before they will be able to look at it.
    I was a bit annoyed at this as I didnt get a single shot out of it, and am looking forward to using it. So i went in, and explained to the guys that it never worked. They said there is marks on it and that i had been using it. (there is marks on it, specifically on the magazine from sliding it in and out, and on the safety switch, both are normal wear and tear and were from trying to get it to work). I asked for a replacement gun and they said they couldnt do anything until the technician took a look at it. (1 month warranty with it). I asked for a refund, and they said they couldnt, id have to talk to the manager. I asked to speak to the manager, they said he wasnt there, I asked for his number and they said they wouldnt give it to me. The gave me the card for the store (and said if i call that number then i would be speaking to them. They said they have a 3 week turn around period and that there was nothing I could do until then. (they did offer to ship to gun to my home address when its fixed.) they also said that it is most likely a spring that fell out of position. If this is the case, then how do i know the spring wont fall out of position again, as i genuinely didnt drop it?
    Are my consumer rights being infringed? am i entitled to money back/ exhange gun?

    They guys were sound enough, but did invite "going to court" if unhappy on more than one occasion.
    They said they checked the gun that it was working after it was paid for to ensure that it was working, but my GF could not confirm this.

    Any thoughts welcome

    Yup you are entitled to your money back and I have got my money back off of that store before so it is their policy, they at the very least could have given you a replacement. But thing is and while I am not doubting you, it is their word against yours and it could have been working prior to leaving, to be fair to take a week to look at a pistol is a bit ridiculous, there is not exactly a full days work in a pistol, mechanically they are quite basic and even a short look may diagnose the problem.

    Just ring their "manager" and see what he says :).

    yes, thats the thing, it is their word against mine, but just in case, i did take photos of the condition of the gun before i left it. there is no damage on the outer shell.

    some places offer reduced rates for buying online so maybe that is the case here.

    Under Sale of Good Act it is repair,replace, refund.
    You are still at the first stage and they have offered a repair. They are not obliged to replace or refund but may do so.
    When the gun is repaired, ask for an extended warranty and get it in writing.
    if the repair fails, then you move to the next option.

    yea, thats more or less what i had thought.

    They didnt call today as they were supposed to, and i didnt think to call them until after 6. maybe theyll be open tomorrow!
