VAT on import from UK

    Hi,
    Just wondering how I deal with invoice from UK company who cannot 0% rate an invoice for export to Eire, as their system is not set up to apparently as they rarely export.

    Can I claim Vat back here if I do pay it there & if so how do I do it?

    We are VAT registered & told them that we would supply them with our vat number.

    Have done many UK purchases before with different companies & never been told that they couldn't 0% rate invoice.

    I'm assuming you are a business operating in Ireland with an Irish VAT number.

    There are no grounds on which a UK supplier is allowed to charge you UK VAT if you give them a valid Irish VAT number. They will have to change their system.

    If you are charged UK VAT, you will not find HMRC receptive to refunding a VAT charge that should not have been made to you. They will say that there is no mechanism to allow the refund. (I've seen this in my office in the last month.)

    You still have to charge yourself Irish VAT at the time of import, and claim the credit at the same time. If you get audited, Revenue will apply penalties and interest even though there's no net tax to pay.

    I just edited original post actually to state we are vat registered etc.

    So long as I know that they are legally obliged to 0% rate the vat then I can get back to them with that before I make any purchase. If they still refuse then no sale!!
