Adult Caution Questions

    Hi There,

    I will be brief, I am in court for quite serious offenses, but I have now received a letter from the Gardai to receive a caution(separate offense), But have been told by a friend that he thought i couldn't accept or receive a caution if i was already in court and am wondering if this is true. the caution is supposed to be for Section 2 Assault

    Certain offences don't come under the adult caution scheme. So if you are in court for robbery or a serious assault then you wouldn't be entitled to an adult caution for those offences. However, as you haven't been convicted for those you can still be considered for an adult caution for minor offences which come under the scheme. Take it for granted that if you are being offered one then you are able to be cautioned.

    Thanks but the caution was set before i ended up in court and they are for charges such as criminal damage and possession of a deadly weapon with intent so can the DPP change there mind on the caution and charge me

    The Gardaí make the choice on the caution. They can indeed change their mind.

    If the decision to caution you was taken before the second incident occurred then you are probably entitled to a caution.
