Sold car to dealer but still in my name

    I sold a car to a used car dealer for cash, I didn't do the usual transfer of ownership because he was a dealer so he said he would look after that.. I gave him the cert and off he went..
    Now 3 months later I get a letter saying the tax is over due..
    I rang him and he said it was a mistake on his part and would have it taken out of my name immediately.
    He said I could check in a few days on motortax.ie and it would show the recent transactions for the reg.

    I have waited 2 weeks and still no updates or recent transactions under my reg??
    Any other way to get the car out of my name??
    Is there some sort of scam going on here??

    He should have followed proper procedure and hasn't, I'd send him a registered letter informing him you are seeking legal advice on the matter, should be all that's required provided he hasn't sold it in turn to someone else who in turn sold in to someone else who in turn sold it to someone else ;)

    Hi guys,

    This is a common problem. If anyone has any issues with receiving M50 tolls after your car is sold, please don't hesitate to give us a shout.

    The general 'rule of thumb' is if you are selling your car privately, get the new owner to sign the change of ownership, write down the date and time and keep a copy for your own records. Use your camera phone or scanner to take a pic of the details. Ensure you send off the documents, don't rely on anyone else!

    I had a similar problelm and the new owner was flying through M50 toll. Contacted eflow and they sorted the charges out quickly.

    Get the registration sorted.

    Tell the dealer you shall be picking up the car as it is still in your name and legally belongs to you. He'll soon change the details then.

    This happened me. My car was scrapped in 2011 (scappage deal). 3 months later got that notice with a warning of fines.

    When a dealer buys a car what are they supposed to do, will they show up as an owner, are they or non dealers allowed sell a car reg in someone elses name?

    And when the dealer produces his receipt for his purchase of the car he'll prove that it's not legally yours. The car being registered in your name does not mean you have legal ownership.

    Name on the logbook means absolutely nothing when it comes to proving ownership.

    A receipt is proof of ownership.

    The setup with dealers doing their own change of ownerships online is crazy as clearly many dealers don't bother putting cars in their names. I wonder why they would do that now?

    Same here. When I sold my last car they went through the toll and never paid. It was only when I contacted e flow to change the reg on my account they informed me that it went through the toll the day it was sold and they took it off my bill

    This Happened today.

    I am looking at replacing my 2nd car.

    Saw a nice 2011, 1 owner car.

    Asked the seller if they were the reg'd owner. NO

    Asked if they were a dealer. Sort Of

    What happens if they are not the reg owner, or the actual owner, but they say they have permission to sell the car, with receipt.

    They probably have the VRC already signed by the previous owner.

    All a big tax dodge imho.

    This is common pratcise for Car Dealers.

    They seem to think its ok to never put the car in their name as they feel by the time the paper work is sent off and returned they will have the car sold on again so they leave it in your name , sell in on , and get the new owner to sign the log book and send it off.

    Not sure how legal this is.

    Have given you a shout, in fact a number of shouts about a charge being applied on my car after it was traded in.

    Had initially contacted E flow when I took ownership of the new car to have my details amended( old car taken off acct, new car put on).All grand, recieved a letter about a trip across the m50 two weeks after had traded in the car, phoned e flow was told not to worry would all be sorted, advised to phone vehicle licensing which I did and they confirmed all was above board on my end regarding no longer being the owner of the car etc.

    Imagine my surprise last weekend when I received a solicitors letter threatening me with court action for the charge and now accumulated fines.

    Phoned e flow again, apparently not much you could do once went to a third party, fair enough I guess. Advised to contact solicitors first thing this morning which I did.

    I was told to send in a copy of my receipt proving I had traded in the vehicle as they information they recieved from the Vehicle licensing place was that I didn't trade the car in until the following month and was therefore liable.

    Got back onto vehicle licencing, only to be told tht yes they did have the correct date as to when I ceased to be the registered owner of the car.

    Another call to E flow this evening to try sort this out, still no joy.

    Ah yes they might have it correct the date Itraded in the car but they (eflow) only have access to when the new owner registered it and not when I traded it in.

    Going by that logic I shouldn't have bothered changing over the details on a pre pay account and paid for none of the trips I made in my new car before I got the new log book.

    Absolutley fuming with your company and that lack of customer care in regards to this issue. I phoned up to advice had traded the car and to have the new car added to the account for billing, so all should have been fine.

    Instead after 4 years of having a pre paid account with you I am being threatened with legal action. So telling people you will sort it out for them, Give me a break.:mad::mad::mad:

    Hi Spygirl,

    Sorry to hear you are having trouble with this matter.

    The date recorded on the logbook will be the date of Change of Ownership, which would mean you would be showing liable for this vehicle up to and including this date (this being the time you owned the vehicle), from this change of ownership date onwards the responsibility for the vehicle lies with the new owner. Any toll trips falling within the time where you were the owner would have correspondence sent to you in relation to it.

    In your case, if you have different dates for the logbook date and your purchase date, you will need to amend these details with the DVCSD (Driver Vehicle Computer Services Devision) with Dept. of Transport in Shannon, Co. Clare. eFlow, as you said, are only provided the Change of Ownership dates, so we can only go by what was provided to us, thus resulting in correspondence to the owner at that time. Unresolved eFlow correspondence would then end up passing to the solicitors/legal department as a formality in the correspondence process.

    If you want me to look further into this for you, to check the details can you send a PM of the vehicle details (for Data Protection reasons). Please provide full name, address, state you are the owner for the time you had it including the date to which you then sold the vehicle. If you have different dates for the logbook date and your receipt date please provide both of these.

    Myself or another representative will then follow-up on this further for you.

    Just an update, been in phone contact with the dealer, they say they have lost the cert??
    they were supposed to have a new cert sent out to me and then I could post it to him and he could then do the transfer.
    Nothing in the post in the last week,

    I have now sent an email demanding the issue be resolved.
