    Yes but if he's as devious as that then I'd expect that enforcing the warranty could be an issue, especially if he's operating out of a Portakabin and has no fixed assets.

    Assuming he is registered as a dealer and not selling a few cars on the side from the front of his garden.

    do you have a warranty even if none is offered
    during sale?

    You won't get a warranty (as in 6 months engine & gearbox type of warranty) unless offered but you do have statutory rights if you are buying as a consumer.

    However as other posters have mentioned before, trying to enforce them on a shady dealer could be tricky. Even if a warranty was given it may be worthless.

    I think the point of people selling multiple cars "on the side", but presenting themselves as private sellers, is to remove the statutory rights from the person they're selling to.

    If you have a problem with the car and the seller tells you to fcuk off, your only remedy then is to take it legal and somehow prove in court that they sell enough cars to be considered a business and thereby get your statutory rights back.

    Is it a dealer posing as a private seller or a private seller who is selling multiple cars as a sideline?

    AFAIK it's the same thing - if you're a private punter and you sell enough cars (I'm not sure what the number is, over what period) then you are, legally, a business and your customer have full statutory rights.

    I think its a given that if its for sale it'll still be in the previous owners name, these types usually aren't in to rf105s and paying tax


    I'd guess that maybe the OP bought a car a while ago which is now giving problems and they want to know if they're entitled to a warranty even though none was implied or offered.


    Could be miles off of course
