Posting someone job while they still hold the position

    Hi,

    Can you tell me if it is illegal to post someones job while they still hold the position? I havent been given any warning, but now find my job has been advertised and interviews held. Please help.

    Might be a same position not necessarily your job. Also, if there were no discussions or warnings in the past about your performance, providing you did not perform gross misconduct where they can terminate your contract immediately you should not have anything to worry about.

    P.S. I'm assuming you have the permanent contract, however if you were on the limited time contract or on probation they do not have to renew it once it is up and are free to look for new staff member.

    Thanks Peanut, No i have a permanent contract. I have had no warnings and did not perform gross misconduct. I just want to know the legalities of it, as what has happened is, a colleague went to mangement and tried to imply that i didnt do my job, however my manager was able to prove that i did. I am pretty sure this same colleague posted the jobs with a recruitment agent.
