My "brand" new 2 month old VW Golf 1.6 DSL van is at present back in the Dealship Garage for the second time as it has failed to start on two occasions. After the first failure to start I was told be the garage that they had discovered a "loose" connection and that they had fixed the problem. Exactly one week later and the van has now been in the garage again this time for two days and their report, on the phone to me, is that they feel that there maybe water getting to to electrics causing "dampness" resulting in the engine shutting down.
For the little I have driven my van I like it, but I would like some advice as to my position if it continues to "stall" What are my consumer rights, can I ask for my Van to be replaced with a new one? how long or how many times can the Dealer continue to investigate before any entitlements as to my disatisfation come into play.I would value any advice anyone can give me.

You have a warranty, this is what it's for, you have to give the dealer reasonable attempts to fix it, replicating an intermittent fault is very difficult.

We don't have a 'lemon law' as in the US.

    Chauffe, Marcel, chauffe!

    Welcome to boards, Clonyn :)

There are no hard and fast rules, but it is important you keep a detailed log of all events. When something went wrong, when you informed the dealer. What they told you they would do about it and when, and a log of what actually happened.

If this should drag out a bit, give them a reasonable ultimatum (in writing) by which time they should have all issues fixed and demand your money back / a brand new car if they should fail your deadline

Hopefully it won't go past that point, but if it does, a solicitors letter (with your full log attached) will probably sort things for you. Best of luck and keep us updated!

As an aside, I didn't know they did a mk6 golf van

Edit: it seems they relaunched it back in July

Thanks for reply, this type of Golf Van reintroduced in June or July. Just frustrated that on two occasions, in such a short time, I have had to stand and watch my new van transported away on a tow truck.

I suppose the things to take from this are
    • It's only one fault, twice
    • They looked after you

first time they told me it was a simple loose connection, this time the feel it might be water (rain?) getting in, possible missing seal somewhere, just dissapointed and would like to prepared if in the future it happens again.

If the symptoms are the same, there's a good chance they thought they fixed it the first time but didn't.

Don't panic, its only a teething problem . Sure even if they gave you another Golf instead, it might be a right ball :)

Biggest issue you'll have if you do try to reject the van is getting a replacement. MK6 production has stopped and I think there was only a handful of the vans brought in to Ireland before it stopped.

No MK7 van available yet and it may take a while to get that approved as a commercial, so it could leave you a bit stuck.

Don't think it would be an issue with the Van version and it doesn't seem to be a common issue across the MK6, so it just looks like you were unlucky. At least you are getting decent support from the dealer and hopefully they'll rectify the issue once and for all.

Got my van back this evening, had a phone call from the Dealer during the day to say the had found that the windscrene had not been put in properly during manufacture which led to the leakage that affected the electrics. They have replaced the windscrene (with a new one) also replaced a "switch box".
I hope this will be the answer to the troubles! They have told me that I will have a visit from one of their service men next week to check.
Thanks to those who responded to my thread.

Sounds like pretty good service from the dealer,
I know its a pisser when something new goes wrong straight away,
Hopefully its plain sailing from here on in!
