RTA, both parties covered by same insurance company.

    I was involved in an rta a few days ago, my car was rear ended by a guy, who according to the guard dealing with it was completely in the wrong. turns out we're both with the same insurance co. should I be concerned about being short changed by the co, who may well try to minimize payouts. I also think they're having trouble getting in contact with the other party to get an admission of liability out of him. is there a danger that they won't follow it up vigorously with him as they might not care whose policy covers the claim??

    Dont worry about it, let the insurance company deal with it, if they do try and allocate some blame on you, you have a guard saying the other driver was completely in the wrong, very unlikely to happen in a rear-end shunt unless there are other circumstances(?). It makes no difference who you or he is insured with.

    You can't use the Gardas off the record comment. He won't be doing a file and will have no opinion unless there's an injury. In this case it'll be left to civil remedy.
    But in this case the driver behind you didn't leave enough braking distance so you'll be without responsibility.
