Ebay - what should I do?

    On 29th September I ordered a mirror off ebay from a seller in America. This week, I still hadn't received it so I emailed her. She said she was away and hadn't posted it until 19th October so could I wait a bit longer. as my paypal protection was due to run out, I opened a dispute, which she answered by telling me to wait. She says I have to wait until 45 days after she shipped and then I have to fill in claim forms for the shipping company, and then wait till she gets a refund from them. So I have 2 questions really

    1. Do I have to wait so long? It seems unfair, it's not my fault she posted so late. also surely paypal will refund me before all that.

    2. Do I have to fill in these forms she is going to send me to get my refund from paypal? What happens if I don't? she's making it sound like there are alot of long forms to fill in and I really can't be bothered.

    you dont have to wait you can open a dispute through paypal and then escalate it to a claim how do you know she even posted the item at all
    at the time of purchase did she let you know in any way there would be a delay in postage of the item

    As i said i've already opened a dispute. She responded by telling me to wait until 45 days and then i'd have to fill in claims forms before i get a refund. Can she do this? What if i escalate it to a claim? And what if i don't fill in her forms?

    Just ignore her and her claims forms thats not how couriers do business she has all informationi that she needs which is that the item hasn't been delivered. Escalate to a claim now as 14days is about the max time I'd wait for any item from the US and its over 21days since she said she'd sent it.

    I would escalate, it is up to the seller to claim off the courier, not the buyer. Paypal will refund you. What does the tracking say?

    The tracking says the item has been posted but not where it is now. Its not a signed for delivery. Will paypal still refund me if i ignore her claims forms?

    It might still arrive, but its totally ridiculous a seller waited 3 weeks to post.

    Its possible they are selling you an item from a third party, as in they order it from an online shop but ship to your address, and that is the delay.

    Or they did just wait 3 weeks to send it themselves, which is terrible service.

    You said the item had been posted, you don't know that all you know is that an item has been posted so when it arrives it could be damaged or not even what you ordered and by then your screwed.

    The sellers forms are a total red herring PayPal will have nothing to do with them so just ignore them and stick with PayPals rules and escalate NOW.

    It could be damaged or the wrong item when posted on time too. The main thing here is, it was posted 3 weeks too late.

    It is too long to wait to open a dispute though, in case there is a problem with the item alright.

    Do not sit on the fence any longer, escalate to a claim. The seller, if genuine, is crazy not to send through trackable means as Paypal will side with the buyer every time in these instances

    Most scams rely on people making assumptions about the seller, the item and its delivery, thats what the scammer wants so better for buyer to take a more cynical approach untill they have the item in their hands and have checked it over.

    In this case you can probably go one stage further and question if the tracking number is even for an item that has been sent to the OP.

    At the end of the day its a judgement call based on a mass of information that only the OP has, making assumptions that what the seller is telling him is 100% gospel shouldn't be one of them. From what we know so far I'd escalate to a claim even if the seller is genuine so they know in future what happens if they don't provide a better service.

    Item could also be stuck in customs but again thats not the OP's problem - escalate to a claim.

I asked her to give me a refund by tomorrow and said that I'll escalate to a claim and leave neg feedback if she doesn't. I just thought I'd give her a last chance before starting all that.

    Well you are being more than fair. The 3 weeks before posting is the real problem here.

    If she refunds then that will be fine. If it was me and they refunded, and then the item arrives and was good, I would pay again. That`s just me though. I had one item take about 6 weeks before. Other than that, it was usually fairly quick for all items, including from the US.

    I would have just escalated to a claim. Why even mention the 'give me a refund or I will leave negative feedback' bit?

    Because a claim takes about 20 days for them to resolve, I believe. This way I get my refund quicker, as she doesn't want neg feedback and has given me a refund!

    For similar non delivery cases with no tracking I've had a PayPal claim settled within 24hours. There is nothing to resolve as the seller can never prove delivery which is why its stupid for sellers to send anything other than low value items they can affort to take a hit on without tracking.
