Minimum wage on a bank holiday?

    Hi folks I'm just wondering whats the minimum wage on a bank holiday. Got my pay slip for last week, got time and 1/3 for the sunday but got basic minimum wage for the bank holiday monday. Being honest I was expecting double pay as thats what colleagues were saying. I work 'full time' in a hotel, full time being hours vary greatly, usualy around 40 a week but could go as low as 20 occasionally but for the week in question I did 60.5 hours.. Can anyone advise me?

    You need to check what the policy is for working a bank holiday. It could be that you get paid normal rate plus a day off within 6 weeks. So in effect this is double pay - i.e you get paid for the day you work and you get an extra paid day off.

    If you work, even if it is part-time, temporary or fixed term you have certain rights. There may be conditions to these rights but you should always have fair treatment. Your rights cover issues such as:

    1. age
    2. disability
    3. gender
    4. race or religion
    5. sexual orientation
    6. the length of your contract
    7. and part-time work

    You also have rights as an employee according to the terms of your contract, including the right to the national minimum wage, the right to sick pay, the right to holiday pay and the right to join a trade union.

    You're entitled to double pay OR a paid day off in lieu within a month OR a paid day off on the actual bank holiday OR one day added to your annual leave.

    There's no automatic entitlement to double pay. You are absolutely entitled to something of the above however.

    also bear in mind, that technically you are not full time if your hours are occasionally 20 per week. For your situation the average number of hours you worked per week in the 5 weeks preceding the bank holiday is relevant, not the number of hours you worked that week.

    So if over the 5 weeks prior to the bank holiday you worked a total of 39 hours or less then you are not classed as full time when calculating entitlement for the public holiday. If you worked a total of 40 hours or more then you are treated as full time when calculating the entitlement.
    Part-time employees

    If you have worked for your employer at least 40 hours in the 5 weeks before the public holiday and the public holiday falls on a day you normally work you are entitled to a day's pay for the public holiday.
    • If you are required to work that day you are entitled to an additional day's pay.
    • If you do not normally work on that particular day you should receive one-fifth of your weekly pay. Even if you may never be rostered to work on a public holiday you are entitled to one-fifth of your weekly pay as compensation for the public holiday.
    In all of the above situations your employer may choose to give you paid time off instead of pay for the public holiday.
