Returning to Ireland from China and trying to claim back tax

    Hi guys,

Returned to Ireland in 2011 after finishing a stint working in a Chinese school for 2 academic years. Managed to get a job that covered September 2011 up until June 2012. I was paying emergency tax on all my income on the tax year of 2011 and ran up a hefty tax bill of a few grand.

I thought that this wouldn't really be a problem as I would get back the tax back as I had not gone over the threshold in order to pay any tax. I have contacted revenue and they seem to want to make me jump through various hoops in order for me to be refunded.

I was paid in Chinese money and taxed by the Chinese Government for any monies that I earned whilst I was over there so does this mean that revenue needs this information? I have recently moved house and tbh I have no idea where any of this documentation would be if I needed it.

Maybe I'm being naive in thinking that as I was in another country paying taxes in order to use their services etc that I can't be charged tax for the same period whilst not being in a country and not using their services etc.

    Any help would be appreciated...

I don't expect them to. I think that you have misunderstood what I am asking. I stayed in China for half a tax year and so paid from my Chinese salary taxes to the Chinese Government. I am not asking the Irish Government to pay me back for those Chinese taxes I paid. I then left China to return to Ireland.

I arrived part way through the Irish tax year and got a job in September. I worked from September to the end of the tax year and paid a huge amount of tax on my earnings because of emergency tax.

I did not go close to crossing the tax threshold as a PAYE employee and as such would like to claim all the tax I paid back.

Now I am under the impression that, as I did not earn the minimum annual wage needed to be taxed then there is no problem and Irish taxes paid should be returned to me. The question I am asking is this correct and if not, why not?

    Thanks

Still not sure what you are actually asking here... you are not gonna pay Irish tax on your chinese income either.

Just claim your tax credits here as normal, don't even mention China. You will end up paying less because your 12 months worth of credits will get applied to 6 months of income.

Once your credits are sorted out you will get refunded whatever you overpaid in emergency tax. Nothing to do with China (the dole here is more than normal wage over there so this is hardly tax fraud).
