    Anyone know when this comes into force? no tax since end July. Also got a ticket from the county council in Galway other day for not displaying a valid tax disk (60 bucks). would they have record of this in Garda station if I try and say it were off the road.

    I would just back tax it if I had the cash, broke student, needed it for work in the summer but going to try and sell it after nct in January.

    They've been on about that for ages. Not relavant to you.

    They won't have any record. Your tax disc is recorded at toll bridges etc. They don't bother checking. They've better things to be doing.

    Seriously, who starts these rumours? At toll bridges, are you having a laugh?

    OP you would be advised NOT to attempt to retrospectively declare your vehicle off the road as a) you have been driving your car which you have just publicly stated and b) because you were already done for having no tax in this same period.

    If the Garda goes off to check the sytem, which they rarely do granted, you will end up in court.

    The Gardaí don't check anything. All they are do is witness your signature that you're declaring your car was off the road, filling this in incorrectly/lying on it is an offence. The Motor Tax people may check.

    there's quite a number of members on boards who would disagree with your post.

    I personally find it offensive - the Gardai in this country work damn hard - no, I'm not a Garda, nor a civil servant ....infact I generally dislike the Gardai but they do work hard and have a tough job.

    As regards the OP - pay the fine, .... if you try to declare it off the road and get caught ...it'll be a lot more serious when you goto court - false declaration (ie fraudulently declaring the vehicle off the road)

    I'm reliably informed that the Gards do check sometimes. Source is the girl who goes to the Garda station to get cars signed off the road for tax purposes.

    Out of interest where was your car when you got the ticket was it on the road?

    At this stage trying to retrospectively declare it off the road is about the dumbest thing you could do. There's a not insignificant chance you could find yourself with a criminal record.

    Pay the fine and pay your back tax to the month in which you were caught. You can't have your cake and eat it. If you choose to break the law then you choose to deal with the consequences of being caught.

    The day the guards have time to ring around the county councils of ireland checking for parking fines for the period that cars are being declared of the road, we may all sleep easy in our beds as all crime has ended. That's why they are bringing in the new system.

    It should work both ways. I payed 3 months in december last and was unable to drive the car from the second week in december until near april. So they got almost 3 clear months for a car unused.

    I assume the disc has to have 3 full months minimum for a refund, which is a bit much imo.

    You should at least be able to suspend it pending getting back on the road.

    All they are doing is witnessing your signature, if a Garda wants to check they can. But the person is committing an offence by falsely declaring the vehicle off the road, the fact a Garda has signed the form doesn't mean that you got away with declaring it off the road, the Motor Tax people should be the ones checking to see if it has been on the road not the Gardaí

    This is a thread about motor tax, what they do the rest of the time is irrelevant, they don't have to check if the vehicle was off the road. IMO they shouldn't check before signing but should after and then do the person for making a false declaration when they have broken a few laws

    For a couple of years I was switching between my car and van. The last couple of times I brought the form in to garda stations (2 different ones) th Gard took the form in to the back for about 2 or 3 minutes before signing it at the desk.

    They could be having a cup of tea or making a copy. They can only check if the vehicle was caught on PULSE, they can't check parking wardens etc.

    What kind of incidents make car appear in pulse system?

    Or export vehicle permanently abroad.
    Or declare it wasn't used at all since taxed.

    Salthill car park, just took it out to walk a dog I was minding for a friend. say I have drove the car about 4 times since back at college. no chance of ever getting a parking spot in the university anyway. Bikes the way to go :D

    Op just read your post and not the rest of the thread so apologies if this is a repeat of whats been said.
    Exact same thing happened me, tax out of date for 3 months. Paid my fine, went and filled out my form at the guards and taxed it at the start of last month having declared it off the road. No issues and I dont expect there ever to be.

    I paid the 60 euro fine, still undecided on weather to chance it, if I had the cash id pay in a heartbeat definitely don't want to end up in court.

    I think ill have to take the gamble. couple a job interviews in the next few weeks so need the car.

    My car was out of tax by 2 months, parked in Salthill car park at Aquarium, got a fine for 60 quid off warden as well. So I went to the cop station, got the form stamped (the Guard didn't check anything, although they do sometimes cos it happened to me) and didn't have to back tax it. Then when I had it taxed I then paid the 60euro fine.

    The reason I taxed it 1st was because I was afraid if I paid the fine 1st that it would be recored therefore I would be admitting to it being on the road and if that went on the system and then somehow the cop checked my reg he'd see that it was on the road un-taxed but also that I got a fine for driving it with no tax, then he'd screw me....

    So I'd suggest in order;

    1) Get form stamped by cops (1st Nov)
    2) Tax car (1st Nov)
    3) Pay fine

    There are a few reasons for which refunds can be applied for. My point would be that the 3 months required to be left on the disc is a bit much. In my case it was an injury, so I think I should have been able to defer the 2 clear months to a time when I was fit to drive again.
