Contesting a claim

    To cut a long story short, on a narrow country road I clipped mirrors with another motorist. This road is a road with no centre line marked and two cars cannot meet without pulling in. There was damage to both mirrors.

    We stopped and the other motorist wanted me to take responsibility. I refused. They took my reg. no and took off. Next thing I get a call from the local gardai saying I was involved in a hit and run. I explained the case, the garda asked me to present documents within ten days as the other party wants to make a claim against my insurance.

    I have requested their details from the gardai as I now want to counter claim for my mirror.

    I am going to ring my insurance in the morning to instruct them not to pay out. My question is, will my insurance listen to me or will they pay out. The other party does not realise that there was an off duty garda from the local station at the scene and saw the whole incident and will corroborate my story

    Both insurers will agree split liability and if they have any sense push it to knock for knock ie:you both deal with your own damage.... There's no way of conclusively deciding who is at fault.

    Always let your insurance company know straight away,never admit your at fault,It's the insurance companies job to sort that out,might have been an idea to film the scene taking note of where the bits of broken mirror is on the road at impact,if its on your side then i reckon the other drivers at fault

    Never thought of it tbh. I thought that common sense would prevail. This happened me about 11 years ago and it was a shrug of the shoulders and sure we'll look after our own.

    This happened Friday but I could not get the insurers over the weekend. I'll call them in the morning though.

    It's not your place to instruct the Insurance Co what to do! They will make up their own mind.

    My car was involved in a (TP) prang on a Saturday afternoon. I got home, and immediately called over the details to my insurance. They took the details down, I called on the Monday to make sure they were aware, and they took over from there.

    As a matter of interest: Why did neither of you pull in the mirrors until you passed?

    Ya but I kept getting disconnected while on hold.

    On the mirrors, just a little misjudgement on one or both parts really. I suppose thats the definition of an accident.

    OP You've done nothing wrong. you could have reported it earlier but to be honest in the time that you've not reported the matter nothing would have probably happened anyway. In relation to instructing your insurer..... You can advise your wishes but they will make the ultimate call on liability so as to save costs..... With respect to the probable outcome of this matter, see my earlier post.....
