can the welfare tell you how much child support to pay?

The court can, if you cant pay you may need to go back to court and get a new order. Never heard of the Welfare getting involved.

Is your ex partner in reciept of benefits? That is the only reason they would get involved.

If you are on benefits, and the mom is on benefits, the child is being fully supported by the state. Your income should not be touched unless you are either working (in which case you should pay exactly 29.80 per week and not a penny more) or claiming for the child on your social welfare payment.

Is there court ordered maintenance in pay - there won't be unless your ex took you to court, so if there is a court order you will definitely be aware of it? If there is no court order, you do not need to pay, if you are on welfare yourself.

Welfare can only look for money from a 'liable relative' if he has a job. Write back and tell them you are unemployed, and that you take the child one day a week and this is your contribution to child support. Enquire if you can claim for the child as a child dependent on your own welfare payment (you probably can't as mom is usually getting the full amount, but you might as well ask the question.)

Please also remember that if either parent gets a job that is 20 hours a week, that parent can claim Family Income Supplement. A lot of fathers don't know that they can claim this. Once you get a job, just set up a direct debit to the mom for 29.80, and then if you are on low wages put in a claim for FIS.

There is a lot of misinformation in your post, the most startling of which is your assertion that a working parent is obliged to pay only €29.80 maintenance regardless of earnings.

You can only claim Family Income Supplement as a separated parent if the children are living with you, or if you are wholly maintaining your ex-partner with whom the children are living. Wholly maintaining means that maintenance paid by you, the FIS applicant, must be the sole income of your ex-spouse, ex-civil partner or ex-cohabitant.

    Hi,

Just separated and would like to know is it reasonable to pay €400 p/m as child support for 2 kids. They live with wife.
    I earn €2000 p/m and live in a room which I pay for €500 p/m.
So €400 for 2 kids - too little, too much or it is ok?

so she’s on rent supplement or Is it HAP? She still has a minimum of €40 per week to contribute to her rent. If she doesn’t work then she has €260.60 lone parent with rent alone at €40 leaving her with €240.60 to support herself and 2 kids.
You are on €500 per week and your rent is €115 per week leaving you with €385 and you want to offer her €100 per week leaving you with €285 for yourself.

I don't know how much she gets. She wouldn't tell me.
I know she gets lone parent, rent allowance and €280 monthly for 2 kids as child benefit.

Could you raise 2 children on 400 a month? Nope. It's too little.

There is a form you can get that you both sign stating you are paying the amount they require in cash every week. Downside is they will take that sum off your ex's money.

If you choose to ignore it they will pressure her for proof that she is legally pursuing you for it and cut her money eventually by the sum.

Been down this route personally. Either way the result is that sum will be taken off one of ye.

They get this sum from a percentage of your average weekly income. You can go in with proof off all of your expenses and try get this sum lowered.

Got my lowered by half by having a letter written by my ex at time stating that I was minding by daughter 2-3 days each week and providing food, clothing etc. Copies of electricity bills, bank statements with my monthly rent highlighted etc.

400/ month from both him and her is 800/month.

For me these math don't add up. Does it not work out as this ?

    Her: 260-40 = 220+100=320

    Him: 500-115=385-100=285

Here’s how maintenance is assessed for both OPFP and Rent Supplement

    http://www.citizensinformation.ie/en/social_welfare/irish_social_welfare_system/means_test_for_social_welfare_payments/maintenance_and_social_welfare_payments.html

He says she’s getting Rent Supplement but doesn’t say how much the rent is, or how much she has to contribute to the rent from her SW payment.
You don’t get to keep all the OPFP +RS if you get maintenance. There’s no reason for maximum SW if the other parent is contributing.

    Rent is 950 p/m.
