Overtime rate

    Hi,

    Johns company currently pays him 175% for overtime but they are trying to cut that down to 125% of his hourly rate. In his contract it doesn't state what rate he should be getting paid for overtime.

    Can they take that off him?

    Pretty much, yes, if the overtime rate is not specified in his contract.

    The only requirement vis-a-vis overtime payments (afaik) are that it's fair compensation. There no requirement to pay more than single time for overtime.

    In situations where they are required to pay over the regular rate (Sundays IIRC) they are also only required to pay 'premium time' this could be 1 cent over the normal rate.
