Squatters Rights and Morgage Repayments

    If an individual is in arrears on morgage repayments can they claim squatters rights regardless of the money that is owed?

    Simple answer is no you can not claim advers possession as you are the legal owner of the property.

    There is a long answer but really not going to go into it.

    So, someone whose mortgage is so far below water, it's resting on the sea bed beside the Titantic, needs to find someone in a similar situation, and swap houses.

    That would be missing the adverse in adverse possession.
