Mortgage horrors - HELP

    So this is my story. We worked and saved very hard to buy our first and what we thought would be our home for the rest of our lives. But then the unimaginable happened. The house adjoining ours was purchased for rental and since that time the landlord has reneged allresponsibility in respect of the house and the tenants. (Our house is semi-detached, our 2 houses are adjoining a green)

    I’ll outline some of the incidents that have occurred over the last 6 years; the first tenants were substantial drug dealers. We endured 5 months of intimidation, raids, not so nice people coming and going at all hours of the day and nightand did I mention intimidation. Christmas that year was horrific for us. Then theymoved out.

    When the next tenant moved in we thought, it can’t be as bad as the last people. But oh how we were wrong. You name it, it went on. Drugs, prostitution, physical abuse, damage to property, stealing, everything. We were terrorised in our home. The violence that went on in the house caused the pictures to fall from the walls in our home. Our home and car have been vandalised. Beatings that went on throughout the nights, parties that lasted days. Windows and doors have been smashed in the house. We had rats all over the place from the build up of rubbish. The tenant had children who were eventually taken into state care. Our lives during this time came to a standstill. She eventually moved out.

    Tenant after tenant were troublesome. Drugs are a huge problem, which has resulted in fights, stabbing, and attempted strangulation. You name it; it seems to have happened here. We did attempt to rent our house, we even secured tenants.However prior to the date they were due to move in, the tenants next door moved out of the house and into a caravan on the front lawn for three & a halfmonths. Needless to say that was the end of our tenants.

    The current tenants are there over a year at this stage. The week after they moved in the Emergency Response Unit were here twice in 5 days. And unfortunately, the situation has not changed except for the variance of authorities coming to the house; the ERU, Special Branch and the Drug Squad and Guards.

    These are the broad details of the activities that have gone on. We are constantly ringing the Gardaí, we have contacted local representatives and, yes we have contacted the PRTB. All to no avail. But fear has and does play a HUGE part of our existence. Fear of the tenants and also the landlord. The PRTB operates an open system of negotiation/communication.We are too afraid to make a complaint through the PRTB for that reason.

    We live under the threat of being ‘burnt out’ because of a feud between the tenants next door and another family. We live in fear.

    We have our house on the market, and there has been an offer placed of €72,000. However it leaves us with a deficit of €100,000. We really are at the end of our tether, we will have a remaining loan of €100,000 and no where to live. Meanwhile the SocialWelfare system that we both pay into every week continues to pay for the tenants next door. And the landlord lives in his castle on the hill, unconcerned.

    We are being driven from our home and will pay for it for the rest of our lives.
    Any help or constructive advice would be very gratefully appreciated.
    I must also point out we are and have been making our monthly mortgage payments, and have been in regular contact with our bank about the situation.

    This sounds more like neighbour issue rather than mortgage issue, I gather from your post that you are both working and rented the property out as could not stand living there anymore.

    Have you been in contact with the gardai, local politicians, ministers, community groups which may be of assistance.

    In terms of the mortgage, if you sell at €72k (presuming the bank are ok with this) then you have to burden the €100k. The choice of house was yours, not theirs so they wouldnt be expected to shoulder the burden. Are you will to accept this responsibility and cut your losses?

    While it is ultimately a neighbour issue from which there doesnt appear to be any resolution or solution. It is a mortgage issue for us now because we have chosen to sell our house. we are being driven out.
    We have contacted all those whom you referenced, however assistance is non committal.
    We have been unable to rent the property due to neighbours so we are still living here, however at this point we have hit rock bottom with the situation.

    So yes we will have the burden of the €100k for the next 29 years!

    This isn't really an issue with the mortgage per se, but a housing one. It's outside the remit of the forum as such, and on that basis I'm closing it off.
