Summons for not producing

    Hi a few mnths ago my brother was stopped for no insurance, and before anybody states the obvious it was a genuine mistake by my parents. His car was taken off him and the insurance was sorted straight away and he went to collect it having to produce insurance to do so. Now he's received a summons in the post for no insurance(fair enough) and on a seperate sheet another one for not producing :eek:

    Why is he being done for both when its obvious he must have produced to get the car back?:confused:

    Err, because he wasn't insured.

    He produced an insurance cert but not one that proved he was insured whilst driving the car.

    At a minimum you your brother will get 5 points plus a nice big fine for no insurance

    AFAIK no insurance is an endorsement rather than points.

    I know personally of one case involving an endorsement and a hefty enough fine, but no ban. Whether it was the exception or the rule I couldn't say.

    Thanks we're hoping that if my parents explain what happened the ban will be smaller but its accepted it was a stupid mistake. We also know that the insurance is going to go through the roof with the points.

    It really was my brother as strange as that may seem.

    Tell him to get himself a good solicitor, IMO the stakes are high enough to warrant it.

    I was in court myself a few months back and I got to see lots of people go up to the judge before me for driving offences, I was quite surprised at how lenient she was, I don't think I heard of anyone getting a ban and there was a good few up for no insurance.

    Driving with no insurance = Mandatory court appearance, points "on conviction" x5 and a "Court Fine", no mention of a ban (but that's the judges decision)

    Rules

    You must have motor insurance to drive a car in your own name or as a named driver on someone else's policy.
    Failure to have motor insurance or driving without insurance in Ireland is generally punishable by:
    • A fine of up to €2,500
    • Disqualification of one year or more for a first offence and two years or more for a second offence, and
    • At the discretion of the court, a term of imprisonment not exceeding six months.
    In the case of a first offence of driving without insurance, the court may decide in special cases not to impose a period of disqualification or to impose a period of disqualification of less than a year.
    Since 1 June 2003, where the courts in Ireland decide not to impose a disqualification, drivers convicted of a first offence of driving without insurance will incur 5 penalty points on their licence record in addition to any other penalty imposed by the court.
    If you commit a second offence for driving without insurance, you will be automatically disqualified from driving. You should also note, that where a member of An Garda Síochána (Irish police force) believes that a vehicle registered in Ireland (or outside Ireland) is being used in a public place without insurance, the vehicle may be impounded.
