work advice needed

    i need some advice, i work 2 days a week as a childminder and i get paid for my 2 days, for the past two weeks the mornings i was due to go to work the mother cancelled on me she took the days of work coz she didnt feel like goin in, im really reliant on the money for the days i work, should i expect to get paid, im due back to work this week, i dont know if i am being cheeky in discussing pay while im of, or should i just say nothing,

    walk away op. what sort of job has mammy that she couldnt be botherd to go in to work?of course your relying on the money who isnt in these times, ask her if she still need you for the two days. i would be looking for another job ,childminder work is very limited at the moment . but still i wouldnt be relying on her .dont think she will pay you if you didnt work for it.

    She should Pay you if she wishes to retain your services, what would she do if you phoned in the morning and told her you "Didn't feel like going in". She is reserving your services, it's her problem if she doesn't go to work, you have set aside the time.

    If you cannot get another job then don't burn your bridges with this woman. If you bring it to her notice she may send you packing and then you will be worse off. I agree with you it is not fair but in this situation there is nothing you can do about it except to look for another job and in the meantime just babysit for this woman if it suits you.

    What does your contract with her say about these situations?

    Its my opinion that you should still be paid, but if you dont have a contract with her Im not sure where you stand legally.

    i dont have a contract i had asked for one when i started but never got one, when i started i gave her my pps number so i was under the impression it was all above board until i was in the tax office, she is paying me cash in hand, i know of 2 other childminders that get paid of their work is cancelled, this is not the first time she has done this and im finding it difficult to get another job, im was dependant on last weeks wages for my car tax, i hate confrontations and feel im stuck in a rut

    The only thing you could do OP is go to the woman and explain nicely what you have told us and see what she says. Tell her you are relying on the money and you have not been paid by her for 2 weeks now. Just see what she says.

    You asked her for a contract? Should you not have been the one giving her a contract? She engages your services as opposed to employs you, I think that you should be looking after your own tax affairs on it? Perhaps Im wrong, but unless she is giving you a payslip then you are effectively self employed. Not that Id imagine there is any tax with such a small amount of work - dont get me wrong, I am not at all berating you, just trying to clarify the arrangement.

    It depends, a person who minds children in their own home is self employed and liable for their own tax/PRSI. If they work in the children's home they are an employee and their employer should be paying all the relevant tax and social insurance contributions.

    when i started working with her she said that she was employing me to mind her kids and i go to her house to do so, so i was always under the assumption she was my employer, i thought if she was bringing her kids to my house then id be self employed

    Well thats great, that means the OP should be covered by employment law even in the absence of a contract!

    OP if I were you I would clarify exactly what rights you have as an employee etc (maybe ring up citizens info or someone in FLAC) and when you have your details straight go to this woman and explain the situation and ask for your money. Im sure revenue would be interested in her if she is employing people and not being above board, so it is in her best interests to keep you happy. As far as you are concerned you gave her your pps so assumed it was all above board.
