Buyer didn`t send the logbook.

    Hi
    I had sold my car over week ago, i had given the logbook to him as he said that he want to take some parts of it and scrapped next day. I was bit confused as it was my first time selling a car so i pass the logbook to him without even filling it, then week later i got penality from eflow and the car is still on me.I had already read few threads about my problem that i can go to solicitor and swear that i sold my car. Any other ideas ? How to write declaration that i`m not a owner any more? How much that solicitor visit will cost me?

    Shouldn't have given the log book but then you probably know that by now. Have you made contact with the new owner. If you have his name and address / number ask the gardai to intervene. Otherwise report the book as missing and get another. :D

    Yep i know that now. I have done stupid thing but what is done that`s done. I had tried to contact him but no answer phone switch of or number is not in use anymore. I`m afraid that all details from him may be fake. Even if i will report book missing someone still be driving my car and god`s know what he will do with it.

    Go to the Gardai and explain the story to them, give as many details as you can about the buyer and tell them you already got a penalty notice and you are concerned there will be more.. take the number of the Garda you deal with and write down the day,date,time and location that you reported it.

    I already been to the Gardai they said "sory we can`t help you, only one thing you can do is go to solicitor and swear that you sold the car". I didn`t take number of Garda.

    Ring department of environment in Shannon to get the correct procedure, you will only need to get a peace commission to sign a form cost 10 to 20 euro for his services instead of an expensive solicitor .

    You really think this is up to the gardai to sort out? what crime was committed other than the op making a mistake when selling his car.
    Some people seem to think they can run to the gardai with every little problem they have and they are obliged to sort it for them.
    He could contact shannon and get it sorted through them.

    what? how can he do this he sold the car. That would be illegal for a start as it's not his car.

    its a flawed system that I don't like about buying or selling cars privatley .

    this can be easily done.

    you sell car, claim to only have one key. keep spare to self.

    don't send off logbook after sale and report stolen.

    quite frankly we need a better system than the logbook

    Nope, but the OP should do anything he can to cover himself when dealing with any further toll, parking, clamping, speeding fines ect .
    The OP made a mistake, why would I think the Gardai would do anything ? Im only suggesting it as a recovery point.

    I wouldn't buy a car w/o 2 keys the logbook sent off in my presence(i would bring a stamped/addressed envelope) a basic bill of sale receipt stating sellers name buyers name date and cars milage especially for a private sale(and i would record the signing of receipt me signing logbook and handing over cash too), and i plan on putting into action on sunday.

    Owner might think it odd but it's as much protection for him as it is for me and if he wants caaaaaaaaaaaaaash ;)

    + a couple of witnesses helps too

    Hi majki0ne,

    If you have sold your vehicle and are still receiving correspondence for it, this means that the vehicle is still registered under your name. If you are having difficulty transferring the ownership details, you can declare yourself the last valid owner of the vehicle up until the date the vehicle left your possession.

    Please contact the Driver and Vehicle Computer Services Division with the Department of Transport in Shannon to request the correct procedure for doing this. You can contact them by phone via landline (061 365000) or lo-call (1890 411 412).

    Regarding the notices you have received from eFlow, if you would like to PM me the details (registration plate number, owner's name and address etc.) I can look into the notices for you.
