Crashed into a steel barrier that was coming up from the ground

    I was exiting a graveyard last Wednesday when i got an awful bang to my car. I didnt know what had happened until i got out & there was a lad standing there with a remote control, he had pressed the button to raise the steel barrier that caused a lot of damage to my car, i didnt know that this barrier was here until i seen the damage. He said he didnt think i was coming that way as there was a right turn back into the graveyard car park, he had let a lady drive in that way & i gave her way then continued on to where she came from. He pressed the button to raise the bollard back to its original position. My car has damage to the bumper, radiator, gear box & Steering bar. There was a sign that a barrier is in operation but i didnt think the bollard was raising as it was only raising as i drove over it. Does anyone think i have a leg to stand on with insuarance ? I called the Gardai, took photos & reported it to my insurance company. :confused:

    Was it a road or enterance that you would have had a reasonable expectation you could go down? You weren't trying to enter a exit or go down a one way incorrectly?

    It was a lane way and the arrow was pointing the way i was going, the manager said i shouldnt have gone that way but there was nothing to tell me different.

    If there is really no sign and the barrier is really manual rather than auto then I would be at the doctor for the crippling pain in my spine and neck

    Personally I cannot see how they can defend this. They're stuffed tbh.

    They operated the barrier as you were driving through. It's their fault.

    If it was just a lane with no signs warning you of bollards or telling you no entry etc.. then your not at fault and should proceed to get compensated and get your car fixed at their cost.

    It's their fault for the lack of signs/warnings.

    I understand, it's sounds like the graveyard is at fault and covered no doubt for this as well, main thing is you are insured, your premium might rise but compared to not being insured or covered it will be minimal. Sorry by the way for your troubles could happen to anyone.

    Legal Advice costs money. You've already paid your Insurer. Let them work this.

    You've a few options here.

    The two main ones are:

    You can claim from your policy and ask your insurer to go after the other party for the bill. This WILL affect your policy until they recover their costs.

    You can claim from the other side. This could take a while though and I can't imagine they're going to be quick admitting liability.

    Give your insurer a chance and if they are worth their salt they will make this painless. If it's becoming a problem then PM me and I'll give you a few names of utter b45tards of Solicitors for you to go to and chase the Graveyards Insurer. Your own Insurer should have their own panel they can refer you to aswell.

    As already stated, IF you are injured then you can claim for this too. I don't condone claiming if not injured but if you are and it's a problem then know your rights. :)

    The chap operated the bollard without the care that was required. A decent solicitor would rip them apart on this. You were going the right way and saw the way to be clear yet the guy saw fit to activate the bollard.

    get back there fast and take loads of photos of road,signs,arrows, entrance signs.or lack of same........cos they will put them up now that an accident has happened. u will have to prove that they were not there..............

    Definitely do this!!!

    If they put up signs tomorrow that should have been there today, and they refuse to play ball, the insurance investigator will visit the scene and determine (incorrectly) that you were in the wrong.

    Take pictures of the entire scene. Long range and close up. Get ones with a car (if you can borrow one) in the same location to show scale and so on.

    Camera phones are worth their weight in gold at times like this.

    Not really sure why anybody came up with these automatic bollards... Lots to clog up / break down , more expensive to buy / install and the risk that a car gets whacked ect. All so no-one has to bend down for a few seconds...
    What I suppose the Bollard just jumped up and hit you?? Well....yeah .....

    I'm 99% sure this is Glasnevin Cemetery that the OP is taking about. There are plenty of signs to state that bollards are in operation and there is definately one right beside the bollard itself. The driver should have turned into the car park immediately before the barrier. They only allow cars pass the bollard if there are people with mobility issues in the car.

    I'm not saying you shouldn't try making a case against the cemetery if there is substantial damage. I'd just be annoyed that the hundreds of people who gave money to the cemetery last Sunday would have it wasted be something like this.

    Also the "CLAIM FOR IT" brigade in this thread are pretty despicable.
