Neighbourly Construction Query

    Neighbour has built 2 structures which I think might contravene planning laws. Can anybody advise?

    1 - Has built a lean to shed onto our boundary fence. The rain runs off into our garden as the roof overhangs.

    2 - Has built his kids a fort of which the base is higher than the top of the fence, so it looks directly into our garden. A BBQ is not the same when his kids are looking directly in and asking my kids what are they having?

    Not sure if it means anything but the fort is clearly visible from the front and the gas boiler flue is inside the fort !!!

    In relation to the gas flue running through the structure, is the structure inclosed or is the structure facing the flue?

    The structure is built around the flue. It does not come through the structure. It terminates inside the structure.

    The structure itself has a roof and 3 walls. There is a window and door ope but these are unfinished. I don't think they were ever going to have a window or door fitted.

    there is ONLY a couple of things wrong with this installation
    1. the wind should be able to blow across the flue therminal at all times
    2. the 'poc's products of combustion do not cause discomfort to passers-by
    3. therminal position has to be 600mm from a surface facing a terminal

    :eek: & Its just wrong having kid play around carbon monoxide

    There appears to be Health & Safety issues and overhanging issues. You need to contact the enforcement section of the LA (in writing to keep a record) and the call Health & Safety.

    Hi there,

    The overhanging is a civil matter and planning enforcement can do nothing in this regard. In my opinion the fort could require planning.

    And when the children suffer from Carbon Monoxide poisoning it will become a matter for the Gardai. ( assuming it as described )

    Have you got photographs?

    What does the rainwater run off onto, paving, your house a flower bed, it shouldn't be running off into your property but it may be more trouble that its worth to resolve.

    In relation to the fort it sounds as if there is plenty of ventilation, ie no windows & doors, not ideal but each to their own. as to the height of it I don't think play structures are covered by planning so theres not much you can do about it other than perhaps plant tall screening plants on your own side of the fence.

    If you don't want to go through the planning process. you could just put some guttering on the overhang and pipe the water back into his side of the fence.
