Maintenance Increase NEED ADVICE

    Hi all

    new to boards reason here is need advice-

    Situation is - partner has child previous relationship, pays €70 week maintenance court order in place

    Social welfare wrote out of blue wanting another €22week!

    Seeking advice on paying or previous experience of similar situation:

    1 court order in place- fully compliant with same
    2 dont actaully have money to pay live in overdraft
    3 means test benchmarked us off SW payments ie allowance given for of 1/4 of mortgage, limiting us at max SW will pay for rent all Even tho We are both working full time paying tax and unable to stay at home mind kids!!
    4 Allowance given for our kids 29 week each!


    Any others got these letters and did u pay/appeal & whats outcome

    New legislation in recently is this result of it!!

    SW told us they want €100 week of dad's for maintenace

    All help welcome

    Never heard of that, i dont know anybody paying more than 70euro per week maintaince for 1 child. What dept in the social was the letter from? Prob best to forward the letter to your solicitor. how can they 'means test' you? Its not your child. Im all for maintance being chased, even docked from wages/dole, but this seems madness. I thought the system in the uk was bad.

    To be honest with you, this seems very strange. If there is court ordered maintenance being paid, and fully in compliance, then there is no need for DSP pay be looking for mainentance. I would contact your solicitor immediately.

    On an aside, €70 p/w for maintenace for 1 child while on means tested payments seem very high, especially from the courts. Might be worthwhile looking to see if this can be reduced downwards. From experience (and ancedotal evidence) the rate seems to be €50 p/w on average. This would equate to over €1,000 in savings per year for you.

    geesh i think ill throw my partner out if i was going to get 92 euro a week for a child why be together at all!

    Thanks folks,

    2nd Appeal sent in to chief appeals so last avenue otherwise its to the courts!!

    This goverment is just interested in squeezing every last penny out of us :-/

    Any idea can you claim tax relief/return on maintenance for a child?

    You can't claim tax relief for maintenance payments for a child. However, if you were married and now divorced or seperated, it is possible to claim some tax relief for the maintenace you pay to your ex-partner. I would contact Revenue to discuss your particular case.
