Contacting your solicitor or IBEC representative is the next logical step.

    Why not call to her?

If the person is off sick with a serious illness or stress, then calling to the house could cause serious problems, could create a stressful situation. Why it's best to get the professionals involved they have experience of what can and can't be done.

Is there an address on the sick cert and is that her address that you know her to be at?

Do you have another phone number for her? Next of kin?

Send her a letter saying you need the phone and ask if someone could collect it, that you can send a courier.

We have an address to the best of my knowledge it is her address will try sending a registered letter, as for telephoning her she will not pick up we have tried alot. The MD has seen her driving around in her other work van. to be honest we are worried about her that she's not picking up anyones calls not even the MD who she would have been quite friendly with.

The voice in your head is telling you something is up.

Decent employees dont act like this, seriously get your legal team ready.

Is it possible the certs are fake?

She has has one of your vehicles or another employment?

It may be legitimate to work part time and retain some benefits.

I hear you Zambia it's her own van she's been seen driving as she also runs her own business, as for stop paying her as we are a small businesss its in all our contracts we dont pay sick pay but she is receiving money from the social should i report to them???

If you believe that she is falsely claiming sickness benefit, then you can report her to the dept of social welfare.

Since you're not paying her, letting her go should be fairly simple. Speak to your company's solicitor about initiating disciplinary proceedings with a view to terminating her employment.

As it's a business phone, just have her number disconnected and transferred onto a new phone. As the connection belongs to you, you would be perfectly entitled to do this even if she was still in work.

Seems alot of contact. This might go against you . You may want to keep it to formal channels only.

In the interim you should look at either assigning the account to somebody else or cancelling it. Most telcos have limits on the packages and you want the best value you can get as a business. No point in customers or suppliers trying to call an employee who is on sick leave. However, I would write to your employee and saying that this is what you are doing.

You should check as to what sort of usage is currently taking place on the phone. There should be almost no calls at this point if she is sick.

This employee also has responsibilities to you and you should have a good read of the employment contract.
