Can tax relief expire? Or can you get it back-dated?

    I qualified for a tax relief scheme which I did not apply for at the time. The scheme was called Living Over The Shop.

    The qualifying period always mentions the time of the building works and planning permissions. If my right to this relief has not expired, I'd send something in.


    Broadly speaking, I know that I would have to ask the building firm and/or architects to supply the costs and my claim will be based on this via an equation. I think that’s right?

    I'd be very pleasantly surprised if anyone knows the answer to this. I haven't a clue myself.

    The 4 year claim limit would apply. If the claim is for any year prior to 2008 no relief would be due now. As far as I can tell Living over the shop ended in July 2006 so your probably outside the 4 year limit.

    The 4-year time limit is a limit on a claim to repayment, rather than a restriction of the relief itself; so if the OP was entitled to the relief in 06 & 07 he may not be able to obtain the repayments it would have given rise to, but may be able to obtain the remaining relief from 08 onwards.. (having said that I'm not familiar with the scheme, so there may be a time limit for claiming the relief specified within the provisions of the scheme).

    Thanks very much for the replies so far. Much appreciated.

    What I have read about the scheme, in terms of expiry dates, refers to the building works or the planning permission. I can't recall noticing anything about preventing someone applying for relief as long as the works etc took place during the existence of this scheme.

    Would an accounting firm know more? Maybe I should hire one?
