Can you pay mileage only.

    Can you pay an employee in mileage expenses only? The employee has a full time job somewhere else and works at night for a security company and checks the sites frequently. If he's paid in mileage expenses only and has no taxable pay, is he still technically an employee if there's no paye, prsi or usc paid on his behalf or can you even do that?

    I've searched the revenue website and can't get a definitive answer anywhere.

    I see two problems with this.

    Firstly, you can only pay mileage, tax free, to an employee.

    Secondly, you would be in breach of minimum wage laws.

    So you would pay the employee an hourly rate for the length of time it takes him to travel and he can then be paid the mileage at the civil service rates?

    Yes, provided all the conditions regarding mileage expenses are met.
