Car Accident, Advice??

    I had a bit of a mishap, while in traffic my vehicle hit into the back of another because my breaks failed. Impact maybe at 10 mph no damage to my jeep however damage to rear of other car. Other driver took my insurance details but only gave me her name and phone number, i assumed they were on the slip of paper she handed me but it wasnt. She left the scene very quickly. The gardai were not called either. I am just wondering will my insurance company ensure she too has insurance before paying out. Also it was only a minor hit but im sure it will be a few hundred in damage to her car but if she tries come back with a personal injury claim too will it count against her that the gards were not called. I dont have a leg to stand on really as i hit into the back of her. I suggested we settle between ourselves I am waiting for her to call me back with a quote but she may change her mind and go for my insurance. Looking for some advice on the position I am in now and how strong her case is if she sees the dollar signs and has a delayed injury and wants to claim injury and car damage on my insurance.

    Inform your own insurance company, if you haven't done so already. Whether she has insurance is completely irrelevant to any claim she might make against your policy. Remember also that, even if you pay to repair her car now, she can still come after your insurance for personal injury later. Me, i'd just pass on the details to my insurer and forget about it.

    To extend your silly logic, it should therefore be okay to run over pedestrians who cross the road when the pedestrian light is red.

    contact your insurance company and inform them of the accident. whether there is a claim or not at least they are notified.

    if the other party claims and you have admitted liability then they will probably ask for you to make a statment and then pay out and thats about it.

    the guards dont do anything at a non injury accident except verify it happened and ensure that ye each have each others insurance information. we then log it ourselves.

    theres no real point reporting the crash days after the event as we can give no evidence whatsoever and it will be a civil matter in any case.

    long and short of it is, if you think the other driver is going to claim then definately give the insurance company a call, tell them it was a low speed collision and there may not be a claim but you just want to give them a heads up in relation to it

    If she was not there, he would have hit the next car up because he was in traffic and his brakes failed.

    The fact her car is a bit flatter at the back and paint scuffs? Regardless, you'd be some piece of work to start that crap and could provoke a personal injury claim.
