employment law question

    Just wondering does anyone know anything about employment law.

    I work in a small company about 200 people and work in a financial team of 10 people. There was recently an announcement that one of the members of the team would now be managing the team.

    The job wasn't advertised, there was no interviews and no one else had the option of going for the job . No one else got a chance to even express an interest in the job. They just gave her the job.
    I should note the girl that got the job is also good friends with the director .

    Can this be legal ?

    Private companies are not obliged to advertise jobs and can recruit internally without giving other employees the opportunity to apply. It must be said although not a legal issue it is very poor human resource management to recruit in such a manner. Not exactly encouraging to employees if a company behaves this way.

    Of course if a disgruntled employee can show that there has been any form of discrimination - for example two employees at the same level, one is pregnant and the other gets promoted - then it's a different story.

    There may also be a contractual obligation on the employer to make known and provide opportunity for employees to apply for open position, whether newly created or made available through vacancy.

    This is not the legal but you can not do much more about this in the legal way because its so hard to prove.

    If you're going to say its not legal back it up with an Act or a case.

    Thankfully private companies are entitled to promote anyone they like without having to clear it with anyone else.

    Perfectly legal and widely practised.
