Doctor/patient privilege

    Hi,

    just a quick question.

    Can a [health] insurance company contact ones doctor to confirm medical conditions mentioned on an application? Does that information fall under doctor/patient privilege?

    Doing exam questions, so this isn't legal advice.

    If you name your doctor on the form, there is almost certain to be a clause on the same form whereby the indvidual authorises the insurance company to seek and obtain further information from the same doctor so effectively the person signing the form is giving a waiver to his/her doctor to supply the information.

    If you refuse to consent in writing to your Dr furnishing the insurance company with information they seek then its pretty much game over for you.
    Dr - patient confidentiality is not a convenient bolt hole.
