Invalidity Pension

    Looking for information for a relative please.

    They were on illness benefit for 2 years and taken off but never had to sit through a medical exam by the department to confirm the inability to work.

    The person in question has had a severe stroke, leaving them with memory loss and dyslexia.
    The weakness caused by the stroke has also left them with scoliosis and osteo-arthritis of the spine.

    They have been denied the Invalidity Pension and now has no source of income or capacity to work.
    The decision has been appealed but what happens if the appeal is also denied.

    Help, very worried.

    If you're appeal is in you have no option but to wait and trust in the system. Have all the medical details ready if they get an oral hearing. The appeal may take a while but any payments will be backdated to when the application was made if they are successful. If you get an oral hearing they will need to explain why they are no longer able to work which judging from your post this should be straight forward, but do not hold back and explain it as if you are explaining it to a child so they understand why you're relative cannot work.

    Try not to worry it will probably be a long wait to the appeal

    Could they not stay on the illness benefit, and send in the certs every week?

    Their illness benefit has now expired after being on it for 2 years. They should contact illness benefit about sending in cert every 6 months to keep their contributions up to date. If they have been turned down for invalidity pension (which is under appeal) they should contact their community welfare officer and see it they can get a payment while appeal is being processed and they should try applying for disability allowance.

    Guys - Thank u all for all the info. I'm am just at a loss as i have never dealt with anything like this and havent a clue who to turn to for the information.

    If his case is under appeal he should apply for supplementary welfare allowance through the community welfare officer (this is a means tested payment).He needs to show that he is appealing the case. But he should look into disability allowance but to be honest I dont think he should apply for this until his appeal is decided upon. If he loses his appeal he should apply but again it is a means tested payment. If you have any further questions please feel free to pm me.

    I went through this recently, except I requested a review instead of an appeal, but the process is essentially the same. DO NOT sign on for any other SW payment such as JSA/illness benefit, whatever. go to see your local community welfare officer and he will pay you until the appeal is decided.
    and don't worry, theres nothing you can do except wait for the result of the appeal. worrying about it won't help anyone. the CWO will arrange payment in the meantime.
