Producing Certificate of Insurance

    Hi all,
    Got stopped by the Gardai today and I was asked to produce my Insurance cert to a station within 10 days. I had it on me at the time but the Garda said I had to produce it in the station.

    When I bring it to the station, should I get a reference number or anything as proof that I produced it?

    They normally write it in to a book they have that records all interactions with the public on a given day.

    They might not given you any receipt or reference number,they didnt give anything to my wife recently when she was asked to produce......1 or 2 months later she got a summons for not producing:cool:

    Exactly same thing happened to me, tried to contact the garda several times after I got the summons but he was in the sub aqua unit and never called me back.

    Ended up having to go to the court on the day, garda didn't turn up and charge thrown out (can't remember exactly what the judge said) cost me a days work:mad:

    When you produce it in the station ask them for a pulse generated receipt.

    Its prints off and they can stamp it.

    *They can ask you to produce it at a station as they have the proper equipment there for checking fraudulent documents, as opposed to a wet windy dark roadside.

    Perfect Turner, thanks for that. Should there be any problem in getting a receipt from them, or is it a common enough occurrence to get one?

    No most will just give you one, but if very busy or printer broken they might not.

    If its not forthcoming when they hand you back your documents just ask for one.

    Or you could ask them to stamp and sign/date the back of the cert itself.

    Why on earth woud he require you to bring it to the barracks when you had it with you when stopped? That's part of the point of carrying it.

    Unless this has been modified by subsequent legislation, it appears that the Garda does not have the power to demand production in a Garda Station in the event that you produce the cert. to him in person there and then...

    69.—(1) (a) Where a member of the Garda Síochána has reasonable grounds for believing that a mechanically propelled vehicle has been used in a public place on a particular occasion (including a case in which the member has himself observed the use) and that the actual user of the vehicle on that occasion was a particular person, the member may, at any time not later than one month after the occasion, demand of the person the production of either a certificate of insurance or a certificate of guarantee or a certificate of exemption in respect of the use of the vehicle by the person on the occasion and, if the person refuses or fails to produce any such certificate then and there, he shall, unless within ten days after the day on which the production was demanded he produces such certificate in person to a member of the Garda Síochána at a Garda Síochána station named by the person at the time at which the production was demanded, be guilty of an offence.

    But under the above section of the RTA 1961 it doesn't appear that the Garda can demand production in the station if the motorist produces a cert. on the spot.

    Open to correction if this has been amended by subsequent legislation.

    What equipment would that be if you don't mind me asking?

    As coylemj has said is there a power to demand production only if the motorist does not produce at the roadside..Has this changed?

    Just to be sure, also keep a not of what Garda station you went into, what time and take a note of the name of the person you're speaking to.
    In that case you can say "I went into X station at 12 O'Clock on this date and spoke to Garda Flaherty who inspected the cert and told me all was OK"
    It sounds a lot better than "I spoke to some guy last week and he said it was grand"
    ESB did something similar to me, I phoned from my new house, spoke to some girl on the phone to get connected and a month later I got home to find the power turned off. When I rang I was told "We have no record of anyone living at this address". State and semi-state bodies are notorious for not giving out names on the phone or in person when speaking to them, so they can say "Who where you speaking to? You don't know? You big, fat liar!"

    My brother had to produce his documents last year which he did , few months later summons for non-production arrived . Guard in the station had failed to record him producing :mad:
    Get a receipt or failing that get the name and number of the Guard .

    I'm going to go up on Monday. I want to give it a few days to make sure it's been inputted that I need to bring the documents in first.
