Ebay - Item not as described (Kinda, Sort of!)

    Hey all,

    Purchased some wallpaper from a UK business seller which arrived today.

    The listing title specified the product colour - eg 23422

    However, in the main body of the item's description, the product code was specified as 23423 (our preferred colour).

    I didn't spot the discrepancy prior to purchase and I doubt the seller was aware of it either.

    So, this would not appear to suit opening an 'Item not as Described' dispute, as there's mutual fault.

    But having spent £20 already on postage to Ireland, I now need to return it (with tracking #) to the seller.

    If we adhere to distance selling regulations, I return the item and assume the cost of doing so. Given there's a mutual culpability, I feel it reasonable to suggest they meet me half-way - i.e. refund me total + postage from initial purchase and I will cover return costs to them.

    Anyone have thoughts or encountered a similar scenario?

    You as the buyer unfortunately are liable for all the return costs.
    The seller doesnt have to reimburse you but there is no harm in suggesting it.

    It's somewhat of a grey area I think, as the item is (and isn't) as described. It'd be interesting to see if ebay afforded greater weight to the listing title or the more detailed description, were a dispute to be initiated.

    I used to sell on ebay before it shifted too far in favour of the buyer. This particular sellers feedback is fine, so I won't kick up a fuss either way - life's too short.

    If the item isnt as described then a paypal dispute is the only option available to you - and ebay wont intervene or make any decisions.
    You could request X amount and keep the item OR if you want a full refund then your only option is return of item, and then you need proof of delivery, which will cost you more as you would need to send it registered post..
    Of course you do get the option of giving negative feedback if the seller doesnt resolve in a helpful and timely manner.
