    Hi guys,

I have a civil case against me, which is causing me and my family alot of anxiety i am very depressed about it at the moment, but it has dragged on for a great number of years and i have turned up each time at the court i was asked and sometimes the case wasnt even mentioned.

My question is if asked again what would happen if i totally ignored it from now on as i do not have any assets anyway and am living off social welfare at the moment.

    Thanks for any help

Some cases do run on for years. Ignoring it could be problematic.

You need to talk to a solicitor to get the other party to either bring the case or drop it. Not proceeding with a case in a meaningful manner is grounds for it to be thrown out.

You might try talking to FLAC http://www.flac.ie/ they will often run clinics in local citizens information centres. Bring the relevant paperwork.

If you feel you are or you have been diagnosed with depression, do keep in contact with your GP and mention the fact to FLAC. Do you have a neutral person that you can discuss your problems with?

    Talk to a solicitor.

You may be able to get it struck out for want of prosecution.

On the other hand it may be better to let sleeping dogs lie.

Thanks for your replies, i spoke to flac and as i was refused legal aid they said there was nothing i could do, i have an appointment with gp but afraid of being on medication again as i was on it before and it made me worse.

Im sorry i dont know what want of prosecution means.

    Thank you

He basicly means if there has been a delay on their part which is unreasonable the court may throw it out. Presumably the party taking the action against you knows your position. Law School 101 - don't sue people without any money.

Get on to FLAC - GCD's FLAC centre was launched yesterday by Mr Justice Clarke so if you're having problems getting an appointment PM me and I'll see if SCR, D8 can see you - it wont be until October at the earliest though.

As for the depression - if you've no money then I wouldn't be worrying about it. There is feck all they can do to you. Just turn up at the court wander in and tell their cousel - I have no money I hope he's got deep pockets to pay you.
