    Hi

    Does anyone know if issuing a plenary summons against a bank

    prevents action by a bank appointed reciever untill the case is heard?

    Very very risky manoeuvre and is a question that is better asked of a solicitor. It depends entirely on the facts of the case. If you are thinking of doing so just to prevent/delay the operation of the receiver, it is a really bad idea as you will just incur legal costs which could be significant.

    It's unfortunate but the Bank are very far down the legal action route if a receiver has been appointed. I don't mean to sound patronising but perhaps if you had engaged with the Bank and/or Court system from the beginning, you wouldn't have to be resorting to desperation tactics. If the Bank has gone this far, they have already incurred significant costs so they will see it through to the inevitable conclusion.
