Distance Selling Regulations when to refund

    Hi Folks,
    Consumer orders item from webshop, payment made and item shipped,
    Consumer notifies webshop that they want to cancel order, within 7 days of order.
    Can someone tell me if refunds (item outbound shipping) are obliged to be paid back to consumer before the goods arrrives back at webshop???

    I would imagine that you are liable for the cost of the shipping to you and the cost to return the item to the supplier. These are costs that are incurred by them and they won't recoup. You'd need to check the T&C's of the carriage to you as this may have supplied under separate T&C's.

    hi Brian,
    eu law says that wbeshop have to refund outbound shipping costs that the buyer paid, the buyer has to pay for the cost to return goods to webshop.

    my questions is: when do they have to refund the funds to buyer, before or after they receive the goods back,
    I have heard that they are obliged to refund $$$ even before they receive the goods back, seems crazy but thats what I have read:

    "When do I have to refund a consumer’s money if they cancel an order?
    Regulation 14 requires that you make the refund as soon as possible after the consumer cancels, and at most within 30 days. You must refund the consumer’s money even if you have not yet collected the goods or had they returned to you by the consumer. You cannot insist on the goods being received by you before you make the refund."

    If I was a retailer I'd be waiting the full 30 days until I had the goods back in stock. They are supposed to have it stated in their T&C's.

    BTW the cool off starts 7 days from date of delivery or receipt of product. Not when it was ordered.
