Claim from accident in 2008!

    I was in a minor car accident with my sister in late 2008. I was about 16 at the time and now I am nearly 20. In this crash I know the people in other vehicle put in personal injury claims and I saw how distressing she found it. In the crash tough I injures my right shoulder and I was in a lot of pain but I masked it with a lot of over the counter pain killers. Over a period of time I sort of got used to it but now I am in college and working in an industry that involves a lot of lifting and my shoulder can be in a lot of pain now. I am at a point now where I feel I have to drop out of college simply because of the pain in my shoulder. So I am asking is there any way I can go about making a claim now or is it to late?

    Talk to a solicitor today. Not tomorrow, not next week, Today. :)

    You need to speak to a solicitor. You can get a good deal of info from the PIAB (google PIAB or "injuries board") but I think they want a claim made inside 2 years from the date of the accident. A solicitor will be able to tell you where you stand and is the only person you should listen to on something like this.

    I wouldn't suffer in silence either. I would be going to the doctor to sort out the problem either way as life is too short to spend any of it suffering while you wait for others to get off their behinds and pay out. Just keep every single bit of paper you have and that you get in the future relating to this for the solicitor and it will help in the event a claim can be made.

    But above all follow the solicitors advice.

    I would have thought you would have a very hard time proving that the injury is from the accident and not from some other incident that might have happened in 3+ years since the accident. Especially if you didnt get it checked out at the time and have some proof that you had an injury result from the accident.

    I also think there is a maximum of 2 years to make a claim, but I could be imagining that. As others have said, best thing to do is talk to a solicitor.

    I have a relation that was doing heavy labour Monday to Friday every week and his back was starting to give in, it eventually gave in one Sunday at home and it took over two years for him to get a claim through as it was caused by work but didn't happen there. I would doubt they would believe that it was caused by the accident after such a length of time, you probably should have got it looked at back then. I'd go to a doctor ASAP and make a start into getting it fixed and seek legal advice, but you're probably just wasting your time here.

    Statute of limitations on personal injury is 2 years
    So you are too late
    Ask a solicitor but I'm sure I'm afraid.

    From memory, Statute of limitations is two years after the age of 18. So you have until your 20. But again, talk to a brief.
