Penalty Points question

    Hello all,

    I got stopped last saturday 31st March for speeding. I hold my hands up, I was at fault. The guard said that he would issue a notice in the coming weeks. My question is this:

    My insurance is due for renewal on the 21st May. If I have not received the points at this stage, do I need to inform my insurance company? Being me, I probably will anyway but I am just wondering can you get away with it?

    As far as I'm concerned you don't have any points until you have it confirmed in writing that you do.

    Hi,

    I think with my insurance company it would only make a difference to my policy if I have more than 2 penalty points.

    If you are awarded the penalty points but after the renewal date, are you not obliged to inform your insurance company of the penalty points being placed on your license as your circumstances have changed?

    Yes you are obliged to tell your insurance company at all times regardless of whether you think it impacts your price.

    Thanks for clearing that up guys. On a related note...

    I bought a car in early march and due to repairs needed on it, I left it with a mechanic friend for the last three weeks. I got it back last sat and then got stopped for speeding! I am going to tax it today but I am wondering if I go to get the guards to sign a declaration of non use, will they consider the fact that I was caught driving it on the last day of the month as a reason to refuse me cover for the month of March? In other words will I have to pay the back tax?

    Any input appreciated

    You are just looking to be caught out trying to do that. You were caught speeding in March, so you're going to have to pay the tax.

    You should definitely back tax the car, as if they were to check the system when you sign the declaration, they would have you for making a false declaration. Not worth it IMO.

    Regards the insurance, unless you have received the fixed notice by the time the renewal comes, I wouldn't tell them. It might never come.

    Ive been pulled over by the Gardai before (for using my phone) and been told that I would get 2 points and a fine, and 3 years later Ive still heard nothing more about it! You dont technically have points on your license until you get the letter through the door, and if your insurance company were to check before you get the notice then they would not see the points against you, so I dont see why you would declare them until you actually have them.

    You would be absolutely stupid to sign a declaration that the car was off the road when the Gardai know full well that it wasnt.

    Nope.

    Points are applied as soon as you sign the fixed penelty notice accepting liability and forfeiting your chance to go to court to appeal the notice.

    Thats when you pay the fine isnt it?

    Okay technically the points arent applied until you either accept them or an appeal has been heard, but my point was that until you recieve the letter you dont even know if the incident has been processed by the Garda; they dont always.

    Yea, its when you pay the fine in the post office or wherever and sign the decleration.

    And even then you have 28 days after which to pay the notice when tecnicnally you do not have any points at all.
