Fence Query

    hope im in the right forum but i put up a fence about a year ago the 6ft size wodden ones and i even left my original fence that was there thus making my garden smaller but an A?? H???e of a neighbour came along one side and has about 3ft of soil right up against the fence pushing the fence over my side
    , can u tell me what i can do ?

    is he allowed do that , cause im sure the fence will rot in no time

    can you not ask them to move the soil back??? if its pushing it in ,its only going to damage it. do yous not talk?

    hes a muppet, and he has it with a small walll going on outer and using fence at back

    If the fence is fully on your side as you outlined above then you either talk him directly or see a solicitor.

    at the end of the day i didnt want to see a solicitor or him

    but just wondering i did have to look over teh fence to see what he had done

    was that tresspasing ??

    I have no idea without seeing it and without carrying out a full boundary check. And even if I could answer that question I wouldnt do so here. Please read our forum charter particularly Section 6.3

    As I said before you have 2 choices. Talk it over with the neighbour and see if you can come to an amicable agreement or alternatively you will have to discuss it with your solicitor.

    Not much help Im afraid but I suspect you already knew your choices were limited.

    If its 3 foot higher on his side he really shoud have built a something on the borderline to keep the soil back from your land if the fence breaks he will be liable for the fence and having to clean up the mess.

    Had an instace where someone did the same thing and that person built a retaining wall but didnt built it properly (and was told of the fact mid build) needless to say the wall collapsed and it went to court as the neighbour wasnt having any of it. The neighbour obviously lost.
