Escalate the dispute to a claim. They're trying to get you to close the dispute so they don't have to refund you at all. Leave negative feedback to warn other of this.

It's also against eBay's terms to sell items you don't actually have in hand. Report the seller and the auction listing to eBay as well.

DONT close the case! You will only get your refund if the case is still open!!!

A merchant is able to refund a dispute and it closes the case automatically unless there is no funds on his balance. like the others, dont close it and escalate it to complaint ;-)
