Common areas not signed over

    Hi,
    I live in an apartment complex in Dublin. The developer has not signed over the Common Area's to the company yet. This being the case are they liable for any maintance issues that need to be fixed in the common areas?
    If so, and our management fees have been used to pay for these issues and pretty major ones at that. Can we get our money back from the developer?

    i would be concerned about common areas not being signed over. A friend is renting in an unfinished estate where the common area is obviously not signed over but suddenly travellers have their horses grazing and sulkey races down the roads. Guards can't do anything about it because the builder gave them permission and rents the grounds out to them.
    Glad my friend hasn't bought in there!
