Just to re-cap, 30 year old in bed with a 15 year old

    Hi all,

Pretty messed up in many ways, this one:

    http://www.independent.ie/national-news/killer-freaked-and-stabbed-man-found-in-bed-with-girlfriend-3045808.html

Unreal reportage. I guess someone who molests an 8 year old would command the headline "man charged with abuse of girlfriend"

This country's gone a bit mad if you ask me. No, a lot mad. This follows on from the 16 year old victim of a shooting who happened to have a 21 year old boyfriend.

There's an obvious distinction but I won't draw it, I'll probably get banned if I do

    "He just freaked out, like"

    I love understatements.

Hopefully this is within thew allowed word quote. If not, referring to the last paragraph of the article.
In 2009, both brothers were sentenced to 14 years for manslaughter. Gerard O'Riordan had 18 months of his sentence suspended while Shane O'Riordan had five years suspended

What year is thisa again? 2012, right? So that was only three years ago onless my math is ****...

Everything I don't like is either woke or fascist - possibly both - pick one.

there was only a 4-year-gap, if they were having sex then that was technically a crime

Also, that article is bafflingly structured, it keeps jumping back and forward in time like a Tarantino movie.

This happened in 2007 so it was even madder back then.

I don't understand the eight-year-old thing - someone explain? Also how is this country gone a bit mad? And what's wrong with the reportage?

He said he picked up a knife that was on the bedside locker and began stabbing Mr Brazier in the back. He said it had not been his intention to kill him.

Oh yeah, he just wanted to spread some Nutella on his back.

His brother, Gerard O'Riordan, said both brothers had been out drinking earlier and Shane had borrowed his phone to contact his girlfriend Yoshiko Scanlon.

Yoshiko Scanlon of the Scanlon dynasty

Manslaughter is otherwise known as Murder in the Third Degree. It shares the same category as Involuntary Manslaughter

    http://en.wikipedia.org/wiki/Murder_%28United_States_law%29#Degrees_of_murder_in_the_United_States

    Am I reading this right?
In 2009, both brothers were sentenced to 14 years for manslaughter. Gerard O'Riordan had 18 months of his sentence suspended while Shane O'Riordan had five years suspended.
Does this mean Shane got off lighter than his brother even though Shane was the one who did all the stabbing?

+1 on what Overheal said but also just to add that from the brief description its clear that he went into a fit if rage... in those circumstances he could use the defense of temporary insanity to get a murder charge reduced to manslaughter (as far as I remember from a brief law class I took few years ago)

It's very straightforward case OP, 15 year old girl had a 19 year old boyfriend and went to bed with a 30 year old man

    What does this mean?

Where is there an eight year old in this story?

Are you seriously complaining about the fact that she was described as his girlfriend?

I wouldn't personally call that a serious criticism. I appreciate that there is a technical, legal basis for statutory rape there if the relationship is sexual, but in reality these cases are not pursued unless there is some element of coercion.

A 19 year old dating a 15 year old is not a very big deal.

Maybe you felt the 'girlfriend' reference pertained to the 30 year old man?

I think the OP read the headline and a few sentences and rushed to boards without even reading the full article

There have been stories in the Indo I have to read a few times to understand them but this one is pretty simple and clear

    Get banned for what OP?

    Legally? No.
    Short version:

    Murder by definition is pre-planned.
Manslaughter by legal definition (and I simplify) is on the more spur of the moment.

All involved sound (and look - and one should not just judge a book by its cover) like a right bunch of characters indeed that you might oft times want to avoid in the street!

You are right there, but yet when we read this..
The jury returned a verdict of death caused by haemorrhage and shock and collapse of the lung due to multiple stab wounds constituting manslaughter, in accordance with the verdict of the central criminal court.

Multiple (12) stab wounds not to mention beating the victim with a chair? I think most rationale human beings, would be inclined to feel that is clearly a deliberate attempt to inflict a fatal injury upon the victim. The interpretation of what constitutes Manslaughter in this country, has become an absolute joke.

He said he picked up a knife that was on the bedside locker and began stabbing Mr Brazier in the back.

How many people keep an knife on their bedside locker? I find that one very strange indeed. Or did he go and fetch the knife, thus indicating premeditation and surely making a manslaughter charge quite laughable?

I'm speculating - not stating a case for either side (frankly, I don't know what the heck really happened).
...but could the Gardi have gotten some info off the then girlfriend, who might have stated how the knife got there (into the room and attack) ?
The paper doesn't say. I don't think we will find out. :)

I guess it might have been there if the 30yo was the knife carrying kind and put it aside before he started frolicking with the girl

Probably (with sense - the only sense he had!) didn't want it sticking in to him, as he was he sticking himself into her!
