Entitled to Redundancy ?

    I have a friend who started work as a general help for a Carpenter. He remained in this position for 2 years. Then he decided he wished to start a Carpentry Apprenticeship with the same employer. He is now 3 1/2 years into the Apprenticeship and his Employer has indicated that he is going to cease his employment at the end of his Apprecticeship. I know that an Apprentice is not entitled to Redundancy but does the previous 2 years worked before the Apprenticeship count for anything ? He has no contract of employment.

    Unfortunately an employer is entitled to dismiss an apprentice within one month of the apprenticeship ending and they do not have to pay a redundancy payment.

    Thanks for your reply. Does the fact that the employee worked for 2 years for this employer before starting the apprenticeship account for anything ? I presume the employer can terminate his employee before the apprenticeship finishes, though I feel this is unlikely at this stage ? Thanks.

    I don't think so, but it's fuzzy.

    It would be worth giving NERA a call to see what they say.

    Perhaps call Citizens Information but I would doubt it...

    Definitely call NERA or Citizens Information (they do know what they're talking about mostly).

    It might be a case that they won't count his apprenticeship (because they can't) but it might just be deemed non-reckonable service. Which would mean he should still get his 2years.

    But once again contact those more in the know.
