    Can two Irish Citizens have a civil marraige abroad is this recognised in Ireland?
    Hi,
    We are an Irish gay couple thinking of have a civil marraige/partnership abroad is this recognised in Ireland? For example if we wanted to get married in the UK or Canada. Does Ireland accept this?

    Under Irish law, a foreign civil partnership/civil union is recognised if:

    - under the law of the country concerned, the partnership/union is exclusive in nature;
    - under the law of the country concerned, the partnership/union is permanent, unless dissolved by court order;
    - under the law of the country concerned, the relationship is officially registered; and
    - in the opinion of the (Irish) Minister, the rights and obligations of the relationship are sufficiently similar to the rights and obligations of an Irish civil partnership.

    The last criterion means that the Minister has to have considered the relevant laws of the country concerned, and decided that they are close enough to Irish laws. From time to time the Minister makes a statutory instrument which lists the foreign countries (and foreign provinces/states) whose laws “measure up”, and whose registered partnerships will therefore be recognised in Ireland, and treated as the equivalent of an Irish civil partnership.

    UK Civil partnerships and Canadian (same-sex) marriages are both recognised as civil partnerships in Ireland. If you are thinking of tying the knot somewhere else you will need to check the position regarding recognition of that country’s registered partnerships.
