whose money was it ?

    Pulled up to a toll boot the other day and pushed €5 note into the slot , after a few seconds it was pushed back because the machine did recognise it or whatever. It was quiet windy at the time and the note actually blew away. It got stuck in a fence about 20 yards and I was able to retrieve it.

    Now if it had blown on down the road , who's money blew away. Is it a case that when you put the money into the machine it becomes the property of toll company ? Now if they decided to spit it back out then it has nothing got to do we me.

    Could i have have just sat there waiting for the attendant to go chase the note and come back and give me my change ?

    I think you should bring a case against the toll company here. You gave them the money. If they were returning you the money, the machine should be capable of holding the money and not letting the wind take it.
    You are the injured party here. You had to chase after the money, using your time and energy when really it was the responsibility of the toll company to recover it.
    So yes, I would consult with a solicitor, and sue for the loss incurred, your time & effort in recovering the funds and most of all, the embarrassment caused as a direct result of the actions of the toll company or its machinery.
    I figure you should be good for €20,000 at a minimum.

    Once during one of my many disputes with toll booth beauties I stepped out and picked up all the change that was lying in the muck under the booth and used it to the pay the difference. I was told I was being reported for 'stealing'.

    Still waiting on the summons . . . . . .

    I dare say (slow evening), that if the machine didn't accept the money, it would be the same as the toll operator not accepting the money.
    So, since your payment wasn't accepted and in fact returned to you, it is your money and if you let it blow away, it's your loss.
    I base this on absolutely nothing whatsoever, except what seems sensible and logical to me. Of course, in legal terms, sense and logic are guilty of contempt of court, have been fined E2m each and are currently locked up indefinitely.
    There is an appeal at the European court of human rights, but I wouldn't hold my breath.;)

    OP's Diary.

    Day 11,756 of this loathsome life.

    Went to town to buy elastic for wife's knickers. Looked down and laces on shoes had come undone yet again. Am I really expected to bend over and tie these laces?

    They were perfectly well tied when I left the house. It's a design flaw and yet here I am having to bend over and tie these useless pieces of string.

    I mean, what if the blood rushing to my head caused me to fall over and bang my head on the ground?

    Would the producer of these laces pay for my medical bills? I'm not sure if I can take much more of this corporate irresponsibility.

    I'm really at my wits end.

    Definitely not your problem. Obviously you did the sensible thing and got the money back and saved a pile of hassle, but if you couldn't get the money back it would have been 100% their problem.

    Yes, except it did accept his money. The human operator analogy would be like this: the guy takes the money out of your hand, then changes his mind and drops the money. In what fcuked up backwards universe does that qualify as "returning" your payment? I would have done like the OP - try to grab the money and put it back in, but if I couldn't catch it, I'd have sat there till they let me through.

    The machine is not the same as a person, it needs to evaluate the note before accepting. Untill it does, its the responsibility of the payee.
