Mat Leave & JA

    I am going on Mat Leave in May and will only get the state allowance €262. at present OH gets no JA as I 'earn too much' - will he be able to claim when I go on Mat Leave? We have one child.

    He will need supply something from your employer to state you are not in receipt of payment while on maternity leave, and make a repeat claim.

    He can either claim JA, or you can claim for him on your Maternity Benefit.

    You will get more money by claiming him on your claim.

    However if your other half is able to get onto a Jobseekers Allowance claim even for 6 months, it may open up access to various support schemes for him, eg. Back to Education Allowance.

    You can also apply for Family Income Supplement while on Maternity Benefit, although it will only last while your Mat Leave lasts, not the full 12 months.

    I get that as it is so will just add new baby to claim.

    I thought we would get more if he claimed? I'm sure last time he got the full rate plus increase for our daughter

    rather than if i Claimed we would only get the same ammount as illness benefit which is around €370?

    Or can he claim JA if I claim for him on Mat Benefit also?

    If he claims JA, your Maternity Benefit will be deducted from the amount he can claim AFAIK.

    Was your other half on Jobseekers Benefit last time? That works differently and your Maternity Benefit wouldn't affect his payment.

    If you claim for everyone you'll get your 262, plus 124.80 for him, plus 2 x 29.80. You only get the Illness Benefit rate if that works out more than the Maternity Benefit rate. You get the higher of the two rates.

    I understand now, thank you so much.

    No he was trying to claim JA as he was self employed so he could get JB but just before I had the baby they said he wouldn't get anything, a week later I had the baby and they told him that he would get it.

    It was back in 2009... I got 270 (Mat Leave), he got 207 (JA) and a child dependant rate. The day I finished Mat Leave his JA got cut off.
