Maternity Leave Questions

    My wife is due to go on maternity leave in May. She will not receive any maternity pay from her company, so I have a few queries that I'm hoping one of you kind folk might aid me with. My understanding is that she is entitled to the following:

    26 weeks Maternity Leave
    16 weeks unpaid Maternity Leave
    +Holidays and Bank Holidays she have accrued during that time

    1. Can anyone tell me at what point during this time should my wife receive payment for the holidays accrued?

    2. If she were to resign during this period, at what point should she hand in her 4 weeks notice? Should it be 4 weeks before the end of the Holidays, or 4 weeks before the end of the unpaid maternity leave?

    Your wife does not receive any payment for normal holidays accrued until she terminates her employment. These holidays are simply available for her to use when she returns to work.

    Payment for bank holidays should be made as usual - e.g. if she normally gets paid monthly, then payment for the bank holiday should be made at the end of that month.

    She can hand in her 4 weeks notice to leave at any time, however it is typical to hand in this notice 4 weeks before the end of the maternity leave (paid + unpaid). If she hands in her notice before her maternity period ends, she will not accrue holidays or public holiday pay for the remainder of her maternity leave period.
